1. Acceptance

By creating an account or continuing to use Top Creative you agree to these Terms. If you use the service on behalf of an organization, you confirm you have authority to bind it; otherwise you confirm you are of legal age.

2. The service

Top Creative is a software platform that uses artificial intelligence to analyze advertising video creatives and to generate creative ideas, scripts and optimization suggestions. Usage is metered in credits, purchased as one-time packs or through monthly plans.

3. Accounts and acceptable use

You must provide accurate information, keep it up to date and keep your credentials confidential; you are responsible for activity under your account. You must not misuse the service, including: unlawful use; fraud or spam; infringing intellectual property or privacy rights of others; uploading content you do not have the rights to; attempting to interfere with security (malware, probing, scraping, circumventing technical limits); reverse engineering; or reselling or redistributing the service.

4. AI outputs and responsibility

Outputs are predictive estimates generated by AI models. They may be inaccurate or incomplete and are not a medical, neuroscientific, legal, financial or other professional measurement or advice. You are responsible for your prompts and uploaded content, for verifying outputs before use, and for holding the rights necessary to the material you submit. You may not use the service to create illegal content, deepfakes, hate speech, malware, or to jailbreak the underlying models.

We may moderate content: remove or restrict content, filter or refuse outputs, and suspend accounts. Rights holders may report infringing content to support@topcriative.com; repeated infringement leads to account termination.

5. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. We retain ownership of the platform, its software, documentation and branding. You retain ownership of the content you upload and grant us a limited licence to host and process it solely to provide the service.

6. Payments, billing and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, taxes, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Prices are displayed in USD; your card issuer may convert to your local currency. 7. Service level and warranties

The service is provided on an "as is" basis. We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim, and we exclude indirect, consequential or special damages (loss of profits, data or goodwill). Nothing excludes liability for fraud, death or personal injury where prohibited by law. You indemnify us against claims arising from your content, unlawful use, or breach of these Terms.

9. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination, unused credits follow the Refund Policy and account data may be exported on request within 30 days before deletion.

10. Governing law and changes

These Terms are governed by the laws of Brazil, with venue in the courts of the seller's domicile, without limiting mandatory consumer protections. We may update these Terms and will publish the updated version on this page. You may not assign these Terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
